抽象行政行為和具體行政行為劃分標準的思考

【摘要】抽象行政行為和具體行政行為作為一學(xué)術(shù)上的分類被行政訴訟法所采用，囿于學(xué)分類，抽象行政行為與具體行政行為不能在行政機關(guān)的全部行政行為中劃出兩者的明確界線，且在理論和實踐中一直未能得到很好的解決。探討兩者的劃分標準，不僅關(guān)系到法院對行政機關(guān)的監(jiān)督范圍和幅度，同時亦涉及到對行政相對人合法權(quán)益的保護力度。因此本文通過對兩者定義的解釋、理論界主要劃分標準的評析、提出了對兩者劃分標準的建議幾個方面來對兩者的劃分標準進行探討。

【abstract】As a academic classification, abstract administrative behavior and concrete administrative behavior are introduced into administrative proceeding. Limited by academic classification, abstract administrative behavior and concrete administrative behavior can not have a clear confines in all the administrative organ’s adiminstrative behavior, and further more it has not been well resolve yet. It is obvious that discuss their compartmentalize criterion, not only relate to the court’s supervision extension, but also relate to the protective degree to the civilian‘s rights and interets. So the article explains the two definition, comments the compartmentalize criterion, and aslo puts forward some suggestions about the criterion of the two definition’s compartmentalization. Finally the article even discusses the criterion of the two definition’s compartmentalization.
