談德主刑輔思想的現(xiàn)實意義

摘 要
傳統(tǒng)德主刑輔思想是儒家思想文化的重要組成部分，對它的研究，大多數(shù)學者通常僅從思想文化的角度進行探索，而沒有真正地把德主刑輔思想與當今現(xiàn)實社會密切結合起來，使它的現(xiàn)實意義得到充分發(fā)揮。一種思想的作用在于促進社會的發(fā)展，使其積極的因素為人所用。德主刑輔思想作為古代社會的優(yōu)秀法律思想，它對促進當時社會穩(wěn)定和維護封建統(tǒng)治起到了巨大的作用，但同時也由于時代的限制，它有自身的局限性，因此，隨著人類社會的向前發(fā)展，它的弊端逐漸暴露，不再適應現(xiàn)代社會的需求。盡管如此，對于德主刑輔思想，我們也不能全盤否定，它仍然有其精華所在，值得我們借鑒。在此，我們換一個視角，從法律制度的角度對德主刑輔思想進行再認識，分析德主刑輔思想的積極影響和消極影響，探討它對法律制度的作用，同時，對如何處理法律與道德之間的關系做進一步的探析，進而闡述這種思想對現(xiàn)代法制建設的現(xiàn)實意義。
