用法律規(guī)范行政審批制度改革

【摘要】行政審批是政府的重要職能之一?，F(xiàn)行的行政審批制度改革明顯滯后于經(jīng)濟體制改革，其中存在的問題制約了市場經(jīng)濟的發(fā)展，因而需要下大力氣深化行政審批制度改革。本文在分析了我國行政審批制度的現(xiàn)狀及其存在的問題之后，對我國正在大規(guī)模進(jìn)行的行政審批制度改革進(jìn)行了反思，指出了其中存在的誤區(qū)，在此基礎(chǔ)上，提出用法律來規(guī)范行政審批制度改革，以確保改革的順利進(jìn)行并鞏固改革的成果。

Reforming the administrative examination and approval system
under the rule of law
【Abstract】Administrative examination and approval is one of the most important functions of the government. The reform in the current system of administrative examination and approval obviously lays behind the reform in the economic system. The problems that exist in the former reform retard the further development of the market economy and thus need further reform. Prior to having a deeper insight into the current system of administrative examination and approval taking place in a large scale in our nation, this essay makes an analysis of its status and the problems lying in it at the beginning, and then brings forward this point: to carry on this reform under the law, which will ensure the reform progresses smoothly and consolidate its fruits.

行政審批有廣義和狹義之分，廣義的行政審批是指行政機關(guān)對行政管理相對人申請的任意事項進(jìn)行審查批準(zhǔn)的行政活動。狹義的行政審批（本文）專指行政許可，是指行政機關(guān)根據(jù)公民、法人、或者其他組織的申請，依法準(zhǔn)予其從事一般法律禁止的某種活動而作出的行政處理決定。行政許可的內(nèi)容是國家普遍禁止的活動。
