內容摘要
共同犯罪是一種特殊而又復雜的犯罪類型，在理論和實踐中都存在許多有待繼續(xù)探討的地方，特別是共同犯罪的刑罰裁量問題因共同犯罪的復雜性而出現(xiàn)不同于一般犯罪的特殊性，而罪責刑相適應原則是我國刑法的基本原則之一，在共同犯罪的刑罰裁量過程中就自然應當?shù)玫襟w現(xiàn)。共同犯罪刑罰適用中如何做到罪責刑相適應原則的要求，就成為理論和司法實踐中關注的焦點。首先，共同犯罪中不同的共同犯罪形式所反映出來的社會危害性大小不同，其在歸責、刑罰裁量過程中就應體現(xiàn)出不同的刑事責任承擔和刑罰適用。而如何根據罪責刑相適應原則來處理不同形式的共同犯罪必然是理論探討的焦點。其次，在同一共同犯罪中，不同的犯罪人因其行為的社會危害性、主觀惡性等不同，在我國現(xiàn)行刑法規(guī)定中各共同犯罪人所應承擔的刑罰相關處罰也各不相同，這是我國刑法對共同犯罪處罰問題規(guī)定中較為能明確體現(xiàn)罪責刑相適應原則的地方之一。再次，在共同犯罪中，除常見的各種共同犯罪，如事前通謀的共同犯罪、必要共同犯罪等之外，有一種共同犯罪形式在實踐中較為難于把握，特別是其處罰問題有必要提出加以探討。此種共同犯罪形式即數(shù)次同種共同犯罪形式，對于這類共同犯罪形式中出現(xiàn)的復雜問題只有進行深入討論才能真正領會出體現(xiàn)在共同犯罪中的罪責刑相適應原則。

The joint offense is a type commit a crime one kind peculiar and complicated as well , existence is all a lot of in theory and practice remain to be continued the place discussing, especially, the joint offense penalty cuts amounts problems appearing to be unlike the particularity committing a crime in general because of the joint offense complexity, but that responsibility for an offence punishment adapts to principle each other is one of our country corporal punishment base, before the joint offense penalty embody in cutting amounts process with regard to ought to at ease. How middle of joint offense penalty suitable for use achieves responsibility for an offence punishment adapts to the principle request each other , become the focal point paying close attention to in theory and actual judicial practice right away. Size reported out by different in the primo , the joint offense joint offense form is different , the person applies to in cutting amounts process in imputation , the penalty with regard to should embody out different criminal liability bearing the sum penalty. How but that punishment adapts to the necessity coming to handle the joint offense being unlike a form principle each other according to responsibility for an offence is theory investigation and discussion focal point. In secondly, being in the same joint offense, the person society harmfulness because of whose behavior , subjectivity are different from committing a crime malignant Deng Bu Tong , the relevance punishes the penalty that what every joint offense person responds to bears in provisions of the criminal law of our country currently in effect also differing from one another , this is that our country corporal punishment can make clear that punishment adapts to one of the principle local each other embodying responsibility for an offence comparatively in the regulation inflicting punishment on a problem to the joint offense. In once again, being in a joint offense, except common various joint offense, if besides joint offense , necessary joint offense exchanging a stratagem in advance etc., assurance comparatively difficult to have one kind of joint offense form in practice, the person inflicts punishment on problem especially being necessary suggest that give investigation and discussion. Kind of joint offense forms are several time of cospecific joint offenses forms here , punishment adapts to principle each other only when the complicated problem appearing to this kind of joint offense in the form carrying out thorough responsibility for an offence in discussing that ability understands to embody in a joint offense out really.
