摘要
當(dāng)今社會，隨著經(jīng)濟(jì)的快速發(fā)展以及各種商務(wù)活動的日益頻繁，經(jīng)濟(jì)交：
易過程中的不安因素也逐漸增多。世界各國為了保障經(jīng)濟(jì)的穩(wěn)定發(fā)展、維護(hù)經(jīng)濟(jì)交易的安全，都制定了各種法律法規(guī)加以限制、保護(hù)。而不安抗辯權(quán)制度便是其中一項保障經(jīng)濟(jì)交易中合同安全履行的重要法律措施。我國《合同法》借鑒了大陸法的不安抗辯權(quán)制度，在第68條、第69條中對其作了規(guī)定。但與傳統(tǒng)大陸法不同的是，我國不安抗辯權(quán)制度吸收了英美法預(yù)期違約制度的一些規(guī)定，體現(xiàn)了大陸法和英美法日趨融合的時代潮流，但難免存在紕漏之處?；诖耍疚脑噷ξ覈贤ǖ牟话部罐q權(quán)制度做出評述。
