摘要
雙邊投資條約是國(guó)際投資法的重要淵源，是當(dāng)今各國(guó)采用得最多的一種締約形式。投資待遇是其中的價(jià)值原點(diǎn)和核心問(wèn)題，而國(guó)民待遇又是投資待遇中不可缺少的一部分。在投資領(lǐng)域中，國(guó)民待遇一般是指締約一方給予締約另一方投資者在其境內(nèi)的投資及與投資有關(guān)的活動(dòng)應(yīng)不低于其給予本國(guó)投資者的投資及與投資有關(guān)的活動(dòng)的待遇。各國(guó)締結(jié)的雙邊投資條約無(wú)論有多復(fù)雜，其主要內(nèi)容都是圍繞投資者及其投資所享有的待遇來(lái)展開(kāi)的。本文擬運(yùn)用比較歸納的方法，對(duì)中國(guó)近年來(lái)所締結(jié)的雙邊投資條約中的國(guó)民待遇的發(fā)展變化進(jìn)行一定的分析。本文將從雙邊投資條約中國(guó)民待遇的概述著手，從國(guó)民待遇的兩個(gè)階段，即外資準(zhǔn)入階段和后外資運(yùn)營(yíng)階段進(jìn)行分析。在此基礎(chǔ)上，對(duì)國(guó)民待遇在晚近時(shí)期國(guó)際雙邊投資條約中的發(fā)展進(jìn)行系統(tǒng)歸納，為后文中國(guó)雙邊投資條約中國(guó)民待遇問(wèn)題的分析提供一個(gè)大背景。文章重點(diǎn)分析我國(guó)雙邊投資條約中國(guó)民待遇標(biāo)準(zhǔn)發(fā)展的狀況，將傳統(tǒng)雙邊投資條約與近年來(lái)新簽訂的雙邊投資條約中的國(guó)民待遇進(jìn)行比較分析，總結(jié)國(guó)民待遇在今后中國(guó)締結(jié)的雙邊投資協(xié)定中的發(fā)展趨勢(shì)并提出筆者的一點(diǎn)建議。

Abstract
The Bilateral Investment Treaty is the most important legal origin of international investment legislation, and it is respectively used in many countries as a contracting form in recent years. Investment treatment is the key figure in the Bilateral Investment Treaty, of which national treatment is considered as a necessary part. In ordinary circumstances, national treatment means that one party should give the other the same investment treatment in investment realm. Whatever the Bilateral Investment Treaty present great complexity, the major content is all about the investment treatment. This article is intended to try a method of induction to research the changes which has happened about the national investment in China's lately contracted treaties.
This article begins with the conclusion of national treatment in the Bilateral Investment Treaty, and then the two periods, the post-establishment national treatment and the pre-establishment national treatment in international treatment are followed to be analysed. On the basis, the writer systematic conducts the practices about national treatment of the recent international investment treaties. And the purpose about all of this is to show a historical background for the study. The key point in this article is the analysis of national treatment between the past and the present in Bilateral Investment Treaties in China. In a word, the writer tries to summarize the development tendency of national treatment in the future Bilateral Investment Treaties in China and wants to give some personal suggestions.
