間諜罪若干問題研析

摘 要:間諜罪作為危害國(guó)家安全的一種重罪，刑法學(xué)界的研究狀況甚為薄弱。本文即立足于刑法規(guī)定，并緊密結(jié)合司法實(shí)踐，對(duì)間諜罪的本質(zhì)屬性、客觀表現(xiàn)、罪過(guò)形式、罪數(shù)形態(tài)、犯罪形態(tài)及其死刑適用等幾個(gè)重大疑難問題進(jìn)行了較為深入的研究。

Studies on Some Issues about the Crime of Espionage
Abstract:Being a very serious crime of offences against state security in the penal code,the crime of espionage is being studied very flimsily.On the basis of the penal code and judicial administration,this thesis studies the underlying knotty problems deeply:the natural essence,the objective form of guilty act,the guilty intention,the form of numbers of crimes,the form of crimes,and the application of the death penalty on the crime of espionage.

間諜罪是指參加間諜組織或者接受間諜組織及其代理人的任務(wù)，或者為敵人指示轟擊目標(biāo)的行為。由于刑法學(xué)界對(duì)間諜罪的研究狀況相對(duì)較為薄弱，本文即對(duì)其中的幾個(gè)重大疑難的問題進(jìn)行初步研究。
