摘 要
刑事被害人補(bǔ)償?shù)膯栴}一直是社會(huì)各界關(guān)注的問題。本文分四大部分就關(guān)于建立刑事被害人國(guó)家補(bǔ)償相關(guān)問題進(jìn)行淺析，第一部分對(duì)刑事被害人國(guó)家補(bǔ)償制度內(nèi)涵及其發(fā)展進(jìn)行闡述，介紹刑事被害人國(guó)家補(bǔ)償制度的歷史演進(jìn)過程，并對(duì)刑事被害人國(guó)家補(bǔ)償制度的各種理論依據(jù)進(jìn)行闡述與評(píng)析，筆者比較贊同國(guó)家責(zé)任說，因?yàn)閺氖褂玫慕嵌葋碚f，國(guó)家補(bǔ)償被害人制度可以起到減少犯罪的作用，整個(gè)社會(huì)的犯罪率也必然會(huì)下降。第二部分以及第三部分從介紹我國(guó)刑事被害人國(guó)家補(bǔ)償制度的現(xiàn)狀，再到分析我們建立刑事被害人國(guó)家補(bǔ)償制度的必要性及意義，提出我國(guó)應(yīng)該建立刑事被害人國(guó)家補(bǔ)償制度。第四部分就我國(guó)建立刑事被害人國(guó)家補(bǔ)償制度的相關(guān)問題，結(jié)合我國(guó)實(shí)際情況從補(bǔ)償?shù)脑瓌t、補(bǔ)償?shù)膶?duì)象、補(bǔ)
償數(shù)額和補(bǔ)償?shù)馁Y金來源、精神補(bǔ)償?shù)任鍌€(gè)方面展開闡述并提出自己的一些觀點(diǎn)。

Crime victims on the establishment of the state compensation system related to thinking

Abstract
Crime victims compensation issue has been a community concern．This article on the four most countries on the establishment of criminal compensation for victims of related issues，the first part of the national criminal victims compensation system and its development content elaborate on the criminal state compensation of victims of the historical evolution of the system，and national criminal victims compensation system ．The theoretical basis for all kinds of elaborate and Analysis，the authors compared countries shared responsibility，because from the point of view，the state victims compensation system can play a role in reducing crime，the crime rate in the community as a whole will certainly decline．And the third part of the second part from the introduction of China's national compensation system of criminal victims of the status quo，to the victims of our countries to establish criminal compensation system and the need for significance，should be established by China's national criminal victims compensation system．Part four on the establishment of China's national compensation system for victims of criminal problems associated with China's actual situation from the principle of compensation，compensation targets for meeting．The amount of compensation and reimbursement of funding sources，such as compensation for the spirit of the five aspects on and make some of their own point of view．
