論行政復(fù)議司法化
摘 要
行政復(fù)議制度自確立以來,對(duì)保障公民、法人、其他組織的合法權(quán)益,監(jiān)督行政機(jī)關(guān)依法行政等方面發(fā)揮了重要作用。但也應(yīng)當(dāng)看到,行政復(fù)議制度在我國建立的時(shí)間畢竟還很短,同國外比較成熟的復(fù)議制度相比,還存在著許多不足和需要完善的地方,尤其要看到我國行政復(fù)議制度受“非司法化思想”的影響,無論是在制度上還是在實(shí)務(wù)上都已經(jīng)陷入制度失靈的困境。行政復(fù)議司法化改革無可避免,行政復(fù)議制度迫切需要彰顯出行政復(fù)議司法性特征,并在此基礎(chǔ)上重構(gòu)行政復(fù)議法律制度。有鑒于此,本文在論述中國行政復(fù)議制度現(xiàn)狀的基礎(chǔ)上,對(duì)行政復(fù)議制度司法化的涵義進(jìn)行了界定。其次,文章通過分析我國行政復(fù)議制度的缺陷指出了我國有必要進(jìn)行行政復(fù)議司法化改革,再論述我國所具備的進(jìn)行行政復(fù)議司法化改革的條件。然后,結(jié)合我國的具體國情,筆者提出了我國進(jìn)行行政復(fù)議制度司法化改革的具體構(gòu)想,認(rèn)為我國應(yīng)該引用臺(tái)灣的行政復(fù)議委員會(huì)制度,具體設(shè)計(jì)的行政復(fù)議委員會(huì)制度包括行政復(fù)議委員會(huì)的組織、運(yùn)行以及監(jiān)督。

Reconsider the judicature of the administration
Abstract
Since the administration establishment, it has played an influential role on safeguarding the citizen, the legal entity and the other organization's legitimate rights and interests, supervising Administrative organ to administrate according to law. But the administration system, which establishes in our country, is also very short. Compares with quite mature administration system, ours also has many insufficiencies and faultless. Especially we must see that Non-judicature thought influences our country administration system. Regardless of system and practice, we all in the difficult position. The reforms of the judicature of the administration are inevitable. The administration system urgently need to show the administration judicature characteristic, and based on this to restructures the administration legal regime. Taking this into consideration, this article discusses on the foundation of the administration system’s meaning, and then divides four aspects to elaborate this article. Firstly, analyzes the Chinese administration system's present situation and the flaw, and pointes out that the administration system, which faced with the difficult position, need to carry on the judicature reform. Secondly, the article through two big legal system country's administration system comparative analysis, summarizes the present world administration to reconsider legal regime's trend of development, namely the judicature of the administration. Thirdly, unifies our country's concrete national condition, elaborates our country to introduce the overseas administration system's feasibility. At last, the author proposes the concrete conception; our country carries on the reform of the administration system judicature. Thought that our country should quote South Korean as well as Taiwan's administration committee system. Besides we must pay great attention on maintaining independence and neutrality of the administration organization, guaranteeing fairness and authority tries of administration aspects decision.

論行政復(fù)議司法化
摘 要
