摘要：適當(dāng)公訴權(quán)是懲罰犯罪與保障人權(quán)的需要，為此各國(guó)都對(duì)公訴權(quán)加以制約，本文通過(guò)比較借鑒世界各國(guó)制約公訴權(quán)的成功經(jīng)驗(yàn)，并針對(duì)我國(guó)公訴權(quán)制約的現(xiàn)狀與缺陷進(jìn)行分析，提出了完善途徑。

Abstract :Proper prosecution is the need of punishing crimes and private right protection., so many countries restrict the power to institute prosecution ,this article compare the successful experience of restricting the right of public prosecution in international community system power, analysis the present condition and blemish of restricting the right of public prosecution in china, putting forward the perfect path.
