摘要
鄉(xiāng)土社會(huì)、國(guó)家法與民間法的研究在今天已經(jīng)形成了一個(gè)繁榮局面，但對(duì)于國(guó)家法與民間法的關(guān)系、國(guó)家法對(duì)待民間法的態(tài)度依然是一個(gè)有待深入、尚無(wú)定論的問題。本文帶著這一問題，以旦平村這樣一個(gè)典型的鄉(xiāng)土社會(huì)為考察中心，著重從鄉(xiāng)土社會(huì)糾紛解決的角度入手，鄉(xiāng)土社會(huì)糾紛的主要類型，糾紛解決主體和糾紛解決方式三個(gè)方面作了較為細(xì)致的描述和分析，來討論民間法與國(guó)家法的關(guān)系；進(jìn)而又從國(guó)家法這一角度，從我國(guó)法治建設(shè)這一高度來認(rèn)識(shí)和分析鄉(xiāng)土社會(huì)中的法治推行過程極其不成功的原因。最后得出結(jié)論，國(guó)家法對(duì)待民間法的態(tài)度和可能的操作模式。

ABSTRACT
Local community, the state law and folk law of today has become a prosperous situation, but state law and folk law, folk law treatment of the attitude is still a pending in-depth, the uncertainty surrounding the issue. This article with this issue, Dan Ping Village, a typical local community centre for the study, focusing on local community starting with the perspective of dispute resolution, native community the main types of disputes, the main dispute resolution and dispute settlement has done three ways A more detailed description and analysis, to discuss the folk law and State law; further from this point of law, the rule of law in China from building a high degree of understanding and analysis of local community in the implementation of the rule of law in the process extremely unsuccessful reasons. Finally concluded that the law treated the attitude of folk law and possible mode of operation.
