摘要: 發(fā)端于晚清的中國(guó)法律近代化是近代中國(guó)社會(huì)發(fā)展變遷的必然結(jié)果，對(duì)中國(guó)法制的進(jìn)步與文明具有深刻的影響。中國(guó)法律近代化的演變進(jìn)程，始終貫穿著批判與吸收的矛盾沖突。本文主要從法律文化形態(tài)、法律制度改革、社會(huì)歷史條件及其發(fā)展過(guò)程論述中國(guó)法律近代化的特點(diǎn)，其西方先進(jìn)法的引進(jìn)、法律人才的培養(yǎng)、立法技術(shù)的改良、司法制度的變革，對(duì)我國(guó)今天的法律現(xiàn)代化有著重要的參考價(jià)值。對(duì)中國(guó)法律近代化特點(diǎn)的研究探討，不止是在于弘揚(yáng)傳統(tǒng)，而且在于它能對(duì)我國(guó)當(dāng)前法制現(xiàn)代化事業(yè)諸多啟示。

On China's laws of the main features of modern times
Abstract
Started in the late Qing Dynasty of China's legal modernization of the development of modern Chinese society is the inevitable result of changes in the Chinese legal system's progress and civilization have a profound impact. China's Modernization of the evolution of the legal process, and always imbued with the criticism and absorb the contradictions and conflicts. This paper from a legal form of culture, legal system reform, social and historical conditions and the development of the Chinese law on the characteristics of modern times, the introduction of advanced Western law, legal personnel training, improved technology legislation, judicial system reform. The modernization of the law is of important reference value. Modernization of Chinese laws on the characteristics of the study, not only to carry forward the tradition, but it is the current legal system of China's modernization cause many inspirations.
