摘要
我國正處于建設(shè)社會主義和諧社會新時期,離婚率的快速上升成為又一社會問題,隨著時代進步,離婚中涌現(xiàn)的新問題,新婚姻法為此增加了許多條款,從更多的方面來保護離婚弱勢方的利益。從目前狀況來看，離婚時的財產(chǎn)處理仍是主要問題，其中婚姻法新增加第40條關(guān)于離婚經(jīng)濟補償問題，是繼離婚經(jīng)濟幫助后在離婚時的財產(chǎn)處理上的又一新突破。這在我國尚屬新生事物,但在國外很早就有了相關(guān)補償問題,目前綜觀各國立法和判例,肯定家事勞動的價值乃國際趨勢,并將家事勞動與夫妻財產(chǎn)制相結(jié)合作出相應(yīng)的制度設(shè)計成為各國的普遍選擇。不過我國的司法時間中卻未能得到有效的適用，民眾對此的認識還不深，而制度上也存在不完善的地方。本文就關(guān)于我國離婚經(jīng)濟補償制度的相關(guān)問題進行探討。

On China's economic compensation system for divorce
Abstract
China is in the new era that build a harmonious socialist society.The rapid rise of the divorce rate becomes yet another social problem . The new marriage had add a large number of new articles to protect the rights of disadvantaged groups in divorce case..Judgjing from the current stiation ，The distributin of the property is still the main problem in divorce case .The new Marriage Law No. 40 article on the issue of financial compensation for divorce is a breakthrough of the distribution of the property after the divorce compensation. That is a new thing in China, but in foreign countries have it has a long history about the compensation measures. Looking at the current national legislation and jurisprudence, we could affirm that the value of family labor is the international trend. Working out corresponding system design according to labor and the matrimonial regime become the universal choice. But China's judicial time has not been effectively applied. Public awareness of this is not cleanly. There are also imperfect system. in this paper, we will explore the relevant issues about the china s divorce on economic compensation system.
