目前，全球公共健康形勢十分嚴峻。藥品專利的國際性保護對發(fā)達國家和發(fā)展中國家的公共健康產(chǎn)生了重要影響。公共健康危機（疾?。┑慕鉀Q依賴于人們研發(fā)出來的新藥，而藥品專利保護制度又對新藥的研發(fā)有著至關重要的作用。高水平的知識產(chǎn)權保護使得受專利保護的藥品價格相對較高，人們無法有效的購買得起藥品，同時，對于新藥研發(fā)機構來說，新藥尤其是治療罕見病或者嚴重流行性傳染病的新藥的研制開發(fā)必須投入大量的人力、物力、財力，必須耗費大量的時間和創(chuàng)造性勞動力，才有成功的可能，因為公共健康危機的出現(xiàn)，耗費了巨大成本研制出來的新藥被人仿制，發(fā)明人沒有得到回報，或者成本都沒有收回，那么將嚴重打擊發(fā)明人的創(chuàng)造積極性。這就使得作為私權的藥品專利權和作為人權的公共健康權之間的關系越來越受到人們的廣泛關注。

On the Relationship of Medicine Patent and Public Health
Abstract
Now, the global public health situation is very serious. The international protection of medicine patent has an important influence on public health of developed and developing countries. The solution of public health crisis depends on new-produced medication and the protecting regulation of medicine patent has an great effect on new medicine development. The high level of intellectual proper protection made the medicine protected by patent worth a higher price, so people can’t afford the medicine effectively. At the same time, regarding the new medicine research and development organization，especially the new drug ,witch treats the rare sickness or the serious epidemic infectious diseases, must to be putting in a lot of manpower, material and financial resources, we must spend a lot of time and creative labor force, likely to be successful. Because of the appearance of public health crisis, new medicine whose development takes vast cost are modeled, inventors couldn’t be paid back, or couldn’t even get their cost back, which will hit inventors creative enthusiasm. The made the relationship between medicine monopoly as personal rights and public health right as human rights gained so wide attention gradually.
