摘要：
中國古代契約制度的存在，對(duì)中國古代社會(huì)的經(jīng)濟(jì)發(fā)展具有積極的意義。但是，因?yàn)闅v史的局限，在近代以來的急劇社會(huì)變革中，植根于農(nóng)耕社會(huì)的契約制度，已越來越顯示出其與社會(huì)發(fā)展的不協(xié)調(diào)性，甚至成為社會(huì)進(jìn)步的重要滯礙因素。進(jìn)入二十一世紀(jì)以后，中國處在前所未有的前面社會(huì)變革之中，如何適應(yīng)這種千年未有的深刻變革的需要，從中國的現(xiàn)實(shí)、現(xiàn)狀出發(fā)，積極探索出一種融合東方西方、跨越古代現(xiàn)代的發(fā)展道路，創(chuàng)造出一種全新的法律文化，將是我們?cè)谛率兰o(jì)面臨的艱巨任務(wù)。
Abstract
China attaches great importance to the traditional social blood relationship to blood ties to the clan system in ancient China is an important supplement to social and political system. Patriarchal through the spirit of ancient China and modern social structure, maintaining social structure of the link, the society is stable, comprehensive concept of patriarchal domination in ancient China in all aspects of social life.Ancient Chinese society hierarchical, officials law "in prison light people", stress safeguarding the authority of the ruling class, ignored people's individual rights. The traditional Chinese society, rule of the Confucian school of thinking is even thinking of "ceremony" as the legislative and judicial guidance to the fundamental principle and safeguarding of the hierarchy "at the rule." This substance to a large extent affected the ancient Chinese public opinion and social values in the pursuit of the interests of the commercial activities of views.
