內(nèi)容提要：
監(jiān)督既是現(xiàn)代國(guó)家法制不可缺少的重要組成部分，又是實(shí)現(xiàn)法制的重要保障。社會(huì)學(xué)問(wèn)題都具有各自的人性理論基礎(chǔ)，法律無(wú)論從條文或法理的層面都應(yīng)該確立正確的人性理論作為基礎(chǔ)和指引。對(duì)人性在哲學(xué)上和倫理上的全面認(rèn)識(shí)直接影響著人們?cè)谶M(jìn)行制度設(shè)計(jì)時(shí)的態(tài)度偏向。從人性在特定社會(huì)中有善、也有惡的具體表現(xiàn)出發(fā)可以建構(gòu)起監(jiān)督權(quán)力或法治權(quán)力的人性基礎(chǔ)。通過(guò)對(duì)人性善、惡理性、非理性的探討揭示法律的社會(huì)基礎(chǔ)中一個(gè)非常重要的方面即作為法律產(chǎn)生和運(yùn)行的基礎(chǔ)人性在法律上有著怎樣的價(jià)值。
Supervision is the an important component of the realization of the rule of the law and also is the security of the legal system.The sociology problems are based on respective humanity theory. Laws should confirm correct human theory as fundament and guideline for either articles of laws or legal principles. The overall understanding of humanity from the perspective of philosophy and ethics directly influences people′s attitudes in designing systems. From the humane society in a particular good but also a concrete manifestation of evil can be constructed supervisory powers or the rule of law based on the power of humanity. :Through the discussion on human natures like kindness evilness rationality and irrationality one aspect of the very important social foundations of law upon which law and its implementation base is revealed and what values the human nature contributes to law are dis-covered. In addition the proposition that law base on evilness of human nature is called into question and rationality is the key foundation of law is raised in the paper.
